Live Building Systems (LBS) cares about your privacy and wants you to be familiar with how we collect, use, and disclose data. This Agreement covers the collection, use, and disclosure of data collected via our software, systems, platforms, websites, applications or any other medium that allows Live Building Systems to collect data and any other third-party website where this Privacy Policy or the LBS Terms & Conditions are posted or linked (collectively, this “Site”).

Please note that this Agreement addresses the data collection and handling practices associated with Live Building Systems only. Other websites, including those provided by our Partners are governed by their own policies. Additionally, Live Building Systems products and services may be subject to their own statements specific to the product or service. We encourage you to review these privacy statements to understand how our products and services use data. 

This privacy policy discloses the privacy practices of Live Building Systems, which operates the website www.livebuildingsystems.com, (the “Site”) and the Live Building Systems mobile application (“App”), all of which are hosted in the United States, whether accessed via computer, mobile device, telephone, or other technology, and any and all utility monitors attached to a user's home, building, office, or apartment.

Customer Information Security

LBS takes all reasonable precautions to protect your information regardless of the form of storage or transmission, including, but not limited to, administrative, physical and technical safeguards. All employees, agents, contractors, or third party partners that act on our behalf are contractually obligated to keep all personal and identifying information confidential and private. LBS is committed to your protection and safeguards your information after you close your account or no longer do business with the company.

Collection of Data

As a utility monitoring company, Live Building Systems collects data about your use of utilities, including gas, electricity, water, and/or oil. LBS collects data in a variety of ways to ensure that our monitoring of your utility use is as up-to-date and accurate as possible. LBS captures utility consumption data using both LBS proprietary hardware and third party hardware attached to your utility meters and lines. This data is securely transmitted to the LBS platform where it is reviewed by trained staff in a private location and displayed on your user portal. LBS also captures data from third party companies, including but not limited to Consolidated Edison Company (ConEd). By using this website or any LBS products, services, or applications, you acknowledge that LBS partners with certain third party utility companies, including but not limited to ConEd, and collect and share data on our customers' use of utilities in order to monitor for over-usage, spikes, or other anomalies.

We also receive additional information through affirmative actions by our users, including, but not limited to, account creation, email sign up, client communications, or other interactions with the Services. When using any of the Services you consent to the collection, transfer, manipulation, storage, disclosure, or other uses of your information as described in this Privacy Policy.

When using the Services, you may provide us with personally identifiable information. This refers to information about you that can be used to contact or identify you, and information about addresses associated with you (“Personal Information”). Personal Information that we collect may include, but is not limited to, your first and last name, email address, birth date, billing information, physical address, utility providers, username, password, telephone number, and zip code. Personal Information may also include information you supply to us concerning your preferences, geographic location, and other interests expressed in the course of your use of the Services, as well as certain representations and warranties that you are required to make while using the Services.

We also collect data when you visit our website or access the LBS application, including, but not limited to, the time and date you access the Services, geographic location, IP address, device information, and cookies to analyze trends, improve and administer the site, track user navigation of the site, and gather broad demographic information to aggregate and analyze for the better understanding and predictability of utility consumption. 

By using any of the Services, you grant LBS permission to collect, use, store, analyze, and transmit such information consistent with this privacy policy.

Uses of Personal Data

We use your data primarily to monitor your home utility consumption in order to identify spikes, leaks, and/or other anomalies. This data is viewed by our trained staff, users on our proprietary platform, and occasionally third party partners, including but not limited to utility companies, power companies, providers, and distributors of oil, gas, water, or electricity. 

We may sometimes use your data for other business purposes, including but not limited to developing or improving product offerings, software, and services, identifying macro trends in energy consumption, and the general operations of the LBS business. 

We may use your data anonymously as part of larger reports on utility consumption in order to promote LBS products and services, create global and local initiatives to reduce energy and resource consumption, and encourage new government and municipal regulations.

Your data and information may also be shared and/or used when necessary with: 

(a)Any government regulatory agency, body, or commission;

(b)Any judicial authority with a valid request for information; 

(c) LBS legal counsel when: 

(i) Customer has violated the Company’s rights; 

(ii)Company must pursue legal action against customer for damages;

(iii)Company must enforce these terms of service;

(iv)Our internal marketing team in order to present you with new offerings and promotions

In addition, we will use Personal Information provided by you for a variety of purposes, including, but not limited, to:

(a)Provide you with and improve the Services;

(b)Verify your identify when you access any of the Services; 

(c) Communicate information to you, including promotions, sales, useful content and offers from LBS and third party providers;

(d)Allow us to contact you about installations, work orders, upgrades, and any communication necessary to provide you with access to the Services; 

(e)Notify you of any changes to the Live Building Systems policies;

(f)Facilitate additional purposes that shall be disclosed at the time the information is requested.

(g)Request a rating or a review on the LBS website or a third party website or platform. 

Sharing of Information

You grant LBS permission to use your information and take other necessary actions regarding such information (as described in the Terms of Service), to provide the Services. LBS will never sell, rent, or otherwise distribute your data to others, except as disclosed in this Privacy Policy. We may share your information with third parties, under the following circumstances:

(a)You give us explicit consent to share such data;

(b)We need to transmit your data in order to provide the Services;

(c) We reasonably believe that providing such information or access to the information is reasonably necessary to comply with legal obligations;

(d)We have a need to investigate and/or prevent illegal activity; or 

(e)We need to hire a third party to investigate violations of our Terms & Conditions. 

We don’t give your personal information to any third-party services, except when it’s necessary to provide the Services (like when we partner with utility providers or payment processors). When we share data with third-party services that support our delivery of the Services, we require that they protect your personal information to the same standards we do. We do reserve the right to disclose personal information when we believe that doing so is reasonably necessary to comply with the law or law enforcement, to prevent fraud or abuse, or to protect our legal rights.

Control of Your Data

All disclosures made to LBS are made voluntarily and with informed consent. If you do not wish to transmit your personal data you are not required to, although LBS may not be able to grant access to the Services without your personal data. LBS may need to store information required by law, however, LBS does not have an obligation to store such Personal Information beyond a reasonable amount of time and LBS will not be held liable for the destruction of such Personal Information. LBS cannot guarantee that all personal data collected will be destroyed upon request.

On request, we will give you a copy of all the personal information about you that we hold. This information is subject to a fee not exceeding the prescribed fee permitted by law. 

User Communications

LBS will keep client communications to a minimum and give you the ability to opt out of any marketing communications we send. Certain reports and alerts are necessary for use of the Services. As long as a user maintains an active LBS account, the user consents to necessary communications regarding the services.

Change of Ownership

If Live Building Systems sells all or part of its business, makes a sale or transfer of assets, is otherwise involved in a merger or business transfer, or in the unlikely event of bankruptcy, Live Building Systems may transfer your personal information and non-personal information to one or more third parties as part of such transaction.

Consent to Transfer

Our computer systems for the Services are currently governed by and operated in the United States, so your personal data will be processed by us in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. Live Building Systems makes no representation that the Services are governed by or operated in accordance with the laws of any other nation. If you create an Account with the Services as a visitor from outside the United States, by using the Services, you agree to this Policy and you consent to the transfer of all such information to the United States, which may not offer an equivalent level of protection of that required in the European Union or certain other countries, and to the processing of that information as described in this Policy.

Changes and Updates

We reserve the right to amend, change, or modify our Terms and Conditions at any time without notice to you. In the event of any changes, notice shall be uploaded and provided upon our website.
